In New Jersey, the statute of limitations sets the timeframe within which a victim of sexual abuse can file a lawsuit against their abuser or a negligent institution. This legal deadline is crucial for survivors seeking justice and compensation for the harm they have endured. The statute of limitations varies depending on whether the victim was a child or an adult at the time of the abuse, and recent legislative changes have significantly impacted these time limits.
In a landmark move to support survivors of childhood sexual abuse, New Jersey extended the statute of limitations with the enactment of the Child Victims Act (N.J.S.A. § 2A:14-2) in 2019. This legislation allows victims of childhood sexual abuse to file a civil lawsuit until they reach the age of 55 or within seven years from the date they realize the abuse caused them harm, whichever is later.
This change provides survivors with a much broader window to seek legal action, acknowledging that many do not come to terms with the impact of the abuse until well into adulthood.
For individuals who were 18 years or older at the time of the sexual abuse, the New Jersey statute of limitations allows for a civil lawsuit to be filed up to seven years from the last act of sexual abuse. This extension aims to accommodate the complexities involved in recognizing and addressing the consequences of abuse, offering survivors additional time to pursue legal recourse.
